General conditions governing the activities of the online store xmas3.eu are constructed in accordance with the Consumer Protection Act (ZVPot), GZS recommendations and international codes for e-business.
Xmas3.eu is an online store managed by the company Allegro d.o.o., a provider of e-business services, hereinafter referred to as the provider.
General conditions governing the activities of the online store xmas3.eu address user rights and business relationship between the provider and the customer.
Information availability (summary of the legislation)
The provider is obliged to the customer to always provide the following information:
a. identity of the company (name and place of business, registration number)
b. contact addresses, enabling quick and effective communication (e-mail, phone)
c. essential characteristics of goods or services (including after-sales services and guarantees)
d. availability of products (each product or service that is offered on the website should be available within a reasonable period)
e. terms of delivery of the product or service execution (method, place and date of delivery)
f. all prices must be clearly and unambiguously defined and it must be clear whether they contain taxes and transport costs
g. method of payment and delivery
h. the validity of the offer
i. the period within which it is possible to withdraw from the contract and conditions for withdrawal, and furthermore if and how much it costs the buyer to return the product

Due to the nature of online business the offer of the store xmas3.eu is often and quickly updated and changed.
Delivery time for products in stock is usually from 1 to 5 days. If the delivery period is longer, we will notify you at least 24 hours later. For products not in stock, the delivery time is longer and lasts from 10 to 20 days. We suggest that you send us an e-mail address at firstname.lastname@example.org, and we will inform you when the desired Christmas products will be available.

When Bank Wire Transfer is selected upon order confirmation as the method of payment, the customer will automatically receive an email confirming the account information for Xmas3. The merchandise will then be reserved for the order and shipped once the funds are deposited in Xmas3’s bank account.
It is mandatory that the customer send a scan or email the bank transaction within 48 hours of confirming the order. Merchandise will be shipped once the funds have reached Xmas3’s bank account.
If the scan or e-mail of the bank transaction is not received within 48 hours of the request, the order will be cancelled.
The merchandise will be shipped once Xmas3 has received the funds and the merchandise is available for shipment.
Xmas3.eu welcomes payments from PayPal Accounts and reserves the right to process orders only if shipped to the same address that the verified Paypal account is registered with.
For Credit Card and Paypal payments Xmas3.eu can request the Bank or Paypal to double check the transaction and the account information. This verification process will delay immediate shipping.
Xma3.eu also reserves the right to ship the order only to the Billing Address.
Purchase agreement (contract) is electronically stored on the server and customer service is available 24 hours a day.
We remind the customer once an order is placed for available items that no changes can be made to that order. Orders placed separately will be shipped separately.
Prices and Currency
Published prices and final invoices are in Euro.
To help clients approximate the Euro values in their local currency, the web site has a currency converter feature. Final credit card and PayPal debited amounts may vary based on currency fluctuations and bank commissions.
Xmas3.eu encourages clients to contact their home bank or their official web pages to receive the accurate price conversion and any bank commissions related to the transaction.
Prices are valid from the time the order was sent.
Prices are valid in the case of payment with the above mentioned methods of payment under the above mentioned conditions.
In the event that the price of the product changes during processing the order, the provider shall inform the customer thereof.
1. Pending order
After placing an order, the buyer receives a notification by e-mail that the order was accepted in the queue. At this stage the buyer has a possibility to cancel the order within 1 hour.
2. Confirmed order
Within two to 48 hours of getting the order, the provider reviews it, checks availability and confirms the order or refuses it with a reason. The provider reserves the right to call the customer, if necessary, to the given contact telephone number. At the time of the order confirmation, the provider informs the customer of the expected time of delivery by e-mail. The contract to purchase the ordered products between the customer and the provider is irrevocably concluded at this stage.
3. Dispatched goods
Within the promised deadline the provider packs the goods, dispatches them and notifies the buyer by e-mail or phone. In the same email the provider also informs the buyer of goods return policy, how to proceed in the case of delay in delivery and in the event of complaint.
The right to withdraw from the purchase and the return of goods
The costumer is entitled to return the goods in three (3) days after receipt without any compensation. However, the buyer is obliged to bear the expenses incurred in returning the purchased item (any possible postage). The goods should be sent in appropriate packaging to: Allegro d.o.o., Cesta na Laze 10, 1000 Ljubljana, Slovenia, EU. Products must be unused, undamaged, in original and unopened packaging and with a valid expiration date. They must be accompanied by an original invoice with the name and quantity of returned goods and the transaction account of the sender (number and unit of the bank) for the payment of the purchase price.
The provider returns the entire purchase price excluding postage costs within 15 days after receiving the returned goods.
The provider is not obliged to accept cash on delivery shipments or shipments that do not meet the provider's general conditions.
Refunds will be processed as soon as returned items have been checked and accepted.
Orders paid by PayPal or by bank transfer will be refunded to the original account.
Refunds will be issued in the same currency as the original purchase. Any differences in the amount refunded are due to exchange rate fluctuations and will not be reimbursed.
Return Terms and Conditions
The Security Tag must still be intact and attached to returned items. Item(s) must not have been used, washed or altered in any way, and must not show any signs of use. The item must be in perfect condition and must not be marked in any way.
Items must be returned with all original tags, packaging and other accessories received with the order with their original boxes, which must not be damaged and/or altered or used as the external parcel for the shipment.
Returns must be packaged in the Xmas3 box.
In the case of defective or incorrect merchandise, clients must follow the instructions above. Xmas3 reserves the right to request photographic support regarding defective or incorrect merchandise before authorizing a return for full reimbursement of shipping and import fees.
Pick-ups for all authorized returns with Xmas3's courier account numbers must originate from the same country of the original shipment.
In the case that the return shipment requires pickup or the payment of any added fees, Xmas3.eu reserves the right to refuse returns sent with a different courier than specified in the confirmation email.
Xmas3.eu reserves the right to refuse returns that are unauthorized and/or not sent in accordance with the return policy detailed online. In the case of unauthorized or non-standard returns, the merchandise will be returned to the shipping address specified in the original order. If an unauthorized return is accepted, Xmas3 will deduct a 15% administrative/re-stocking fee from the refund.
For any issue not explicitly mentioned, the European normative for long-distance commerce prevails.
The provider must deliver the goods or services in the promised time, which is indirectly dependent on the delivery performer. The delivery of packages is carried out by Pošta Slovenije d.d., Delivery service, DPD & Fedex. Expected delivery time is stated in Shipping category, sometimes due to special circumstances may be even longer. In the event that you do not receive the package within 14 working days, inform us on email.
Xmas3 does not deliver to P.O. Boxes.
As per International Laws regulating Commerce and Trade of imports and exports ALL Xmas3 orders are shipped out of Ljubljana - Slovenia WITH AN OFFICIAL INVOICE declaring the exact total of merchandise purchased in EURO.

Available items: immediate dispatch
Orders with items that are already available will be shipped on the first business day following order completion. During sales or special promotions, shipping times may be longer.
Xmas3.eu reserves the right to delay dispatch in the case of unforeseen circumstances.
Shipment Information > Successful Shipment Delivery
Upon delivery of every order, Clients are asked to inspect the box carefully BEFORE signing for the delivery. Xmas3.eu packages are carefully sealed in paper box (cardboard tube) with a Xmas3 logo print tape around the cardboard tube.
If for any reason the box looks tampered with, either sign for the package with reservations or refuse the package. In the event that the box has been signed for with an unauthorized signature or there is evidence that the package has been tampered with, open a claim immediately with the courier and contact us.
If the package is not successfully delivered to the Client's address due to a lack of cooperation from the client (wrong telephone number, wrong address, absent at address, non-compliance with import regulations) as per the Xmas3.eu commercial agreement, the package may risk being sent back to Slovenia at the Client's expense including any import fees that may be assessed upon re-entry to Slovenia. These fees will be deducted from any eventual reimbursement.
Shipment Information > Shipment Insurance
Xmas3.eu shipments are insured against theft and accidental damage at no additional cost to the Client. Once the shipment reaches the destination, the goods are no longer insured.
Protection of children
Advertisements must be clearly displayed (taking into account age) and must be clearly separated from games and competitions.
Any communication intended for children must be suitable to their age and must not exploit the credibility of children, their lack of experience or sense of loyalty.
The provider may not take orders from someone, knowing or suspecting that it is a child without specific permission from parents or guardians.
The provider may not accept any personal data relating children without expressed permission from their parents or guardians. The provider may also not issue data taken from children to a third party, except to parents or guardians.
The provider shall not offer free access to products or services that are harmful to children.
Absolution of responsibility
The provider shall in the best effort assure that the information published on the website is up-to-date and accurate. However, the characteristics of products, their availability and price change so rapidly that the provider fails to correct the information on the Internet. In this case the provider informs the customer of changes and enables them the cancellation of the contract or the replacement of the ordered product.

The provider checks the opinions before their publication and rejects those that contain obvious false, misleading or offensive information. The provider is not responsible for the information and opinions and is absolved of any liability arising from the information in the opinions.
All photos of products are symbolic and do not provide the characteristics of the product.
Complaints and disputes
The provider respects the existing consumer protection laws.
The provider is required to establish an efficient system of dealing with complaints. In the case of any problems the costumer can contact the provider by email. The procedure for submitting complaints is possible by e-mail or writing to the company.
The provider will confirm the receiving of a complaint within five working days and explain the course of further procedures to the customer.
The provider is aware that essential characteristic of consumer dispute, as far as the judicial resolution is concerned, is its disproportion between the economic value of the claim and costs incurred in resolving the dispute itself. This is also a major obstacle that prevents the consumer to initiate proceedings before the court.
Therefore, the providers should do their best to resolve any disputes by mutual agreement.
